Work Your Way to
Permanent Residency in Canada
Canada offers a variety of work permit options to support its labour market needs and welcome skilled foreign workers. Whether you’re planning to work temporarily, join a spouse, or transition to permanent residence, understanding the type of work permit that suits your situation is essential.
Open Work Permit
An Open Work Permit allows you to work for any employer in Canada, with a few exceptions (such as employers who are non-compliant with IRCC regulations or offer striptease, escort, or erotic services).
- No job offer required at the time of application
- Not employer-specific or occupation-restricted
- Greater flexibility for workers and newcomers
Common Eligibility Scenarios:
- Spouses or common-law partners of certain temporary foreign workers or international students
- International students eligible for a Post-Graduation Work Permit (PGWP)
- Applicants awaiting a decision on permanent residence under certain immigration streams
- Vulnerable workers facing abuse under employer-specific permits
Open work permits are ideal for individuals seeking work freedom and flexibility while in Canada.
Closed Work Permit
A Closed Work Permit, also known as an Employer-Specific Work Permit, allows you to work for only one employer, at a specified location, and often for a set period.
- Tied to a specific employer and job
- Often requires a Labour Market Impact Assessment (LMIA), unless exempt
- Changing employers typically requires applying for a new permit
Scenarios:
- Foreign workers hired under the Temporary Foreign Worker Program (TFWP)
- Intra-company transferees under International Mobility Program (IMP)
- Agricultural or seasonal workers under specific federal streams
This permit is suitable for individuals with a firm job offer from a Canadian employer and a willingness to commit to one role and location.
LMIA Based Work Permit
A Labour Market Impact Assessment (LMIA)-Based Work Permit is a subtype of the closed work permit and is granted when an employer has received a positive LMIA from Employment and Social Development Canada (ESDC).
What is an LMIA?
An LMIA is a document that confirms that hiring a foreign worker will not negatively impact the Canadian labour market and that no Canadian citizens or permanent residents are available to fill the job.
What is an LMIA Based Work Permit?
An LMIA-Based Work Permit is issued when your Canadian employer obtains a positive Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC).
- A valid job offer from a Canadian employer
- An approved LMIA from ESDC
- Employer must meet specific recruitment and wage standards
Advantages
- Can lead to permanent residence under certain Express Entry streams (e.g. arranged employment points)
- Clearly defined employment terms and conditions
This pathway is commonly used when no Canadian worker is available for the position, making it a valuable entry route for many skilled foreign workers.
Spousal Open Work Permit
A Spousal Open Work Permit (SOWP) allows spouses or common-law partners of certain temporary residents in Canada to work for any employer without the need for a job offer or Labour Market Impact Assessment (LMIA). It provides employment flexibility while supporting family reunification in Canada.
- Not employer-specific – you can work for any employer across Canada
- No LMIA required
- Allows you to gain Canadian work experience
- Typically valid for the same duration as your spouse’s or partner’s permit or study period
Advantages
- Spouses/common-law partners of foreign skilled workers in Canada on a valid work permit
- Partners of international students enrolled in eligible post-secondary programs
- Spouses of permanent residence applicants under the inland sponsorship class
- Eligible under International Mobility Program (IMP)
This pathway is commonly used when no Canadian worker is available for the position, making it a valuable entry route for many skilled foreign workers.
Global Talent Stream
The Global Talent Stream (GTS) is a part of Canada’s Temporary Foreign Worker Program (TFWP), designed to help Canadian employers quickly hire highly skilled foreign talent in specialized occupations. This employer-driven stream offers expedited work permit processing for eligible workers and companies.
- Two-week processing for eligible applications
- Requires a Labour Market Benefits Plan (LMBP) instead of a traditional LMIA
- Tied to a specific employer and job role
- Employer must be designated or hiring under the GTS Category A or B
- Ideal for tech, STEM, and specialized positions
Common Eligibility Scenarios:
- Tech companies hiring software engineers, data scientists, and AI/ML experts
- Canadian employers referred by a designated referral partner under Category A
- Employers hiring workers in occupations listed on the Global Talent Occupations List under Category B
- Vulnerable workers facing abuse under employer-specific permits
This stream is ideal for highly skilled professionals with a confirmed job offer from a participating Canadian employer who is ready to support fast-tracked immigration. It provides a unique opportunity to launch your career in Canada’s innovation economy—with fewer delays and greater certainty.
